Now that Obama has been reelected for his second term as President, many have been speculating on where this could lead the economy and where this could lead marijuana: will MJ laws survive until the end of his next term? Although Washington and Colorado passed their own state laws legalizing marijuana for recreational use, according to Justice Department spokesman, Nanda Chitre, “The Department’s enforcement of the Controlled Substances Act remains unchanged,”.
This pushes the whole issue of States Rights, but even Colorado’s own Governor gave some discouragement to the new measure.
Colorado Governor, John Hickenlooper, came out raining on the pot parade by saying “Federal law still says marijuana is an illegal drug, so don’t break out the Cheetos or Goldfish too quickly.”
President Obama originally promised not to waste Justice Department resources on cannabis dispensary raids, basically insinuating that there were bigger fish to fry and that he would defer to state laws. Since Obama’s initial pro stance, Obama crudely flip flopped on the issue and has become the worst President on Marijuana, BY FAR! Yes, even though he said “I inhaled frequently, that was the point.”
In 2011, Obama had his federal prosecutors in California coordinate plans to shut down the majority of dispensaries in the state. During these raids, 16 pot shops and their landlords received letters that threatened criminal charges and property confiscation if they refused to close down. In the letters, they said that “federal law takes precedence over state law and applies regardless of the particular uses for which a dispensary is selling and distributing marijuana.”
This means that the Justice Department has not been complying with State Laws throughout Obama’s first term, and would lead one to assume that they’re ready to hit the gas these next four years.
So what does this mean for the future of marijuana, and the laws that just passed in Colorado and Washington?
Obama has allowed his Justice Department to go even further than they have during Bush Jr.’s administration against state MJ laws while continuing the same harassment as the previous administration. For example, Obama’s ATF fear mongered gun shops with threatening letters telling them not to sell firearms to Medical Marijuana Patients. Obama, as previously mentioned, has also enabled Federal Prosecutors to bully and close down MMJ clubs with threats to banks and landlords that deal with Cannabis dispensaries.
A petition to legalize marijuana that was started by retired Baltimore narcotics Officer Neill Franklin, was submitted to the White House in 2011. The petition had 17,000 signatures and was one of many petitions rejected by Obama’s Whitehouse.
“It’s maddening that the administration wants to continue failed prohibition polices that do nothing to reduce drug use and succeed only in funneling billions of dollars into the pockets of the cartels and gangs that control the illegal market,” Neill Franklin said in his official statement.
So, the future of these newly passed state laws to allow for recreational use of marijuana is looking fairly grim. Since the feds have harassed and raided the majority of legitimate dispensaries in states like California, who only allows for medical marijuana patients to use and possess cannabis, imagine what they’ll do to states like Colorado and Washington for allowing recreational marijuana use!
